Court Dismisses Suit by Impeached Edo Deputy Governor, Phillips Shaibu, Over PDP Governorship Primary

A Federal High Court in Abuja has dismissed the lawsuit filed by impeached Edo State Deputy Governor, Phillips Shaibu, which sought to nullify the February 22 governorship primary of the Peoples Democratic Party (PDP) in the state. The primary had declared Asue Ighodalo as the winner.
In his ruling on Monday, Justice James Omotosho stated that Shaibu lacked the legal standing to challenge the primary’s outcome as he did not fully participate in it and was absent from the venue on the day it was conducted. The judge emphasized that Shaibu’s lawsuit was premature, noting that he had failed to exhaust the internal dispute resolution mechanisms within the PDP before turning to the court.
Justice Omotosho underscored that, as a PDP member, Shaibu was obligated to adhere to the party’s rules and regulations, which require aggrieved aspirants to first approach the party’s Appeal Committee. The judge highlighted that there was sufficient evidence supporting Ighodalo’s victory in the primary.
This decision underscores the importance of adhering to internal party mechanisms for resolving disputes before seeking judicial intervention. The court’s ruling serves as a reminder of the procedural obligations party members must fulfill to ensure their grievances are heard and addressed within the party framework.
