Federal High Court Upholds Deposed Emir of Kano’s Rights, Awards N10 Million Damages

In a significant legal ruling, the Federal High Court in Kano has upheld the rights of movement and freedom to civil liberty of the deposed Emir of Kano, Alhaji Aminu Ado Bayero, while also awarding him N10 million in damages against the Kano State Government.
Presiding over the case, Justice Simon Amobeda of the Federal High Court 3 emphasized the court’s jurisdiction in adjudicating matters of fundamental human rights violations. The judge noted that the applicant, Alhaji Aminu Ado Bayero, successfully presented evidence demonstrating violations of his rights by the Kano State Government.
Justice Amobeda highlighted that in May 2024, the Kano State Government purportedly deposed the applicant through social media announcements and ordered his arrest within 48 hours, actions deemed unlawful by the court. These actions, including imposing a de facto house arrest on the deposed Emir, were found to contravene his rights to liberty and freedom of movement as enshrined in Sections 35(1) and 41(1) of the 1999 Constitution.
The court’s decision included an injunction against law enforcement agencies from further arresting, detaining, or harassing the applicant. Additionally, it mandated the Kano State Government to pay N10 million in damages to Alhaji Aminu Ado Bayero for the breach of his fundamental rights.
While the judge struck out the applicant’s request for the costs of filing and prosecuting the case, the ruling marks a significant legal victory affirming the protection of individual rights and freedoms in Nigeria’s constitutional framework.
